In a momentous legal case regarding the constitutionality of the CDC’s nationwide eviction moratorium, a federal judge has ruled in favor of housing providers.

This ruling marks a pivotal step toward holding the federal government accountable for the significant financial and constitutional challenges faced by landlords during the pandemic.

A lawsuit, led by several housing providers with support from legal advocacy groups, claimed that the CDC had overstepped its authority. The suit argued that the moratorium violated both the U.S. Constitution and the rights of housing providers under property and contract law. The court agreed with this argument.

The federal judge ruled that the CDC’s moratorium was unlawful, allowing housing providers, who were previously unable to enforce their leases, to seek damages. This decision opens the door for landlords across the country to demand accountability and compensation for their losses.

This case represents not just a legal victory, but a vindication for every housing provider who complied with the law, honored lease agreements, and faced penalties for doing so.
